When You Need an Essure Birth Control Lawyer

Between 2002 and 2016, hundreds of thousands of American women used the Essure device as a means of permanent birth control. This device, developed by Bayer Healthcare, is reported to cause serious side effects and complications.

Recent studies show that the Essure device allows pregnancy in some users and that it causes abdominal pain, bleeding, vaginal infection and, in severe cases, death. Due to these problems, plaintiffs across the country are seeking compensation through defective product lawsuits.

If you or a loved one experienced severe side effects while using the Essure device, you may be entitled to compensation. To learn more about your options, contact OnderLaw to schedule a free consultation.

Filing a legal claim against a large company can feel overwhelming and confusing.

You trusted their product, yet you have experienced negative side effects.

Filing a lawsuit is a common course of action to recover damages for medical expenses, lost wages, and other negative or costly experiences you may have had from using Essure birth control. Your side effects could require lengthy, or even lifelong, medical care.

Filing a legal claim can be a very complicated process, but it’s one that our lawyers have the experience and compassion to manage effectively. We guide you through every step of the legal process, from filing paperwork and handling negotiations on your behalf, to fighting for the maximum compensation you may be entitled to.

When starting this journey, it’s important to choose a knowledgeable, experienced, and compassionate attorney to take on your Essure birth control lawsuit.

We take on Bayer so that you can focus on what matters most: your recovery. Our goal is to negotiate a fair settlement on your behalf or, if necessary, fight for your rights and maximum compensation in court.

Your attorney will also represent you in negotiations with the product manufacturer and their insurance and legal representatives, so you won’t need to deal with them yourself.

We will always try to negotiate a fair settlement on your behalf, or if necessary, fight for your rights and maximum compensation in court.

Most Essure complications have been reported through clinical trials.

Mild to moderate side effects include cramping, vaginal bleeding, nausea, vomiting, dizziness, and lightheadedness; longer-term Essure side effects include abdominal pain, perforated fallopian tubes, and hypersensitivity reactions.

Essure device inserts have led to unintended pregnancy, including tubal pregnancy.

Reported severe Essure complications include

  • abdominal, pelvic, or back pain
  • tear or hole (perforation) in the uterus or fallopian tubes
  • unintended pregnancy
  • allergy or hypersensitivity reactions
  • unexpected movement of the inserts to the abdominal or pelvic cavity

If a patient and healthcare provider decide to remove the Essure device, another surgery may be required.

The FDA monitored the use of the Essure device continually after it first obtained approval in 2002. In 2015, the FDA held an Obstetrics and Gynecology Devices Advisory Committee meeting to assess the health and safety risks of Essure. Following this, Bayer added an FDA black box warning to the Essure device, informing users about the risks of Essure use and removal.

In 2018, the FDA restricted the sale and distribution of Essure to healthcare providers who agreed to have patients review literature explaining the risks of Essure birth control before using it. Later that year, Bayer Healthcare announced that the Essure device would no longer be sold or distributed. By 2019, an Essure recall led to all unused Essure units being returned to Bayer.

Prior to the Essure recall, more than 5,000 Essure users reported side effects to the FDA.

If you experienced abdominal pain, bleeding, vaginal infection, or other severe side effects while using Essure, you may be entitled to compensation.

Deciding to file a lawsuit against a negligent party is a big decision. You may feel confused or overwhelmed about bringing a suit against them. However, it’s important to remember that the lawsuit is simply a means for recovering the financial compensation you need to recover from your physical and emotional trauma.

Your defective product lawsuit won’t devastate Bayer Healthcare, but it can help you acquire the justice and compensation you deserve. Essure lawsuits are about more than just acquiring fair compensation, however. They are also an opportunity to hold medical device manufacturing companies responsible for their actions.

When you work with our attorneys to litigate your Essure lawsuit, rest assured that your rights will be enforced and protected. Much like pharmaceutical lawsuits, defective product lawsuits are one of the few ways to hold these large medical product corporations accountable.

More than 750,000 women consented to have the Essure device implanted without knowledge of the risks.

If you are one of them, you may be entitled to compensation.
